Terms & Conditions These Terms & Conditions Of Use constitute a legally binding agreement made between you and YourPCM Limited (henceforth known as the “company”, or “we”, “us” or “our”) concerning your subscription to and use of the YourPING platform and any related services, websites (such as this one), notifications, communications or connected systems operated by us. By creating an account, subscribing to or continuing to use YourPING, you confirm that you have read, understood and agreed to the Terms & Conditions below and will remain bound by them for as long as you use the service. 1) YourPING is a personal check-in and notification platform designed to help users maintain regular contact through automated reminders and escalation notifications. 2) YourPING is not a medical service, healthcare provider, emergency response system, monitoring service, security system or life-saving service. 3) YourPING does not guarantee that anyone will respond to alerts, notifications or escalation messages sent by the platform. 4) If you are in danger or experiencing a medical emergency, you must contact the emergency services immediately by dialling 999. 5) You understand and accept that YourPING relies on third-party infrastructure, including internet connectivity, mobile networks, email systems, push notification services, SMS gateways and cloud hosting providers. 6) We cannot and do not guarantee that notifications will be sent, received, delivered on time or responded to by your trusted contacts. 7) You acknowledge that delayed, failed or missed notifications may occur for reasons outside our control. 8) YourPING is provided on an 'as-is' and 'as-available' basis, and you use the platform entirely at your own risk. 9) To the fullest extent permitted by law, the company shall not be liable for missed check-ins, failed notifications, delayed notifications, failed escalation attempts, injury, illness, emotional distress, financial loss, business interruption or death arising from the use of, or inability to use, YourPING. 10) Responsibility for your personal welfare, wellbeing, safety and emergency response arrangements remains entirely with you and not with the company. 11) You agree to provide accurate account information and keep your contact details and trusted contact information up to date. 12) You are responsible for configuring your check-in schedule appropriately and ensuring your devices remain connected, operational and capable of receiving notifications. 13) You understand that if your device is switched off, disconnected from the internet or has notifications disabled, YourPING may not function correctly. 14) You confirm that you have permission to provide the personal details of any trusted contacts added to YourPING. 15) You agree not to add individuals without their knowledge or consent. 16) We will use reasonable endeavours to keep personal information secure and confidential in accordance with UK data protection legislation. 17) You retain ownership of the personal data you submit to YourPING. 18) The company agrees to use reasonable endeavours to protect and securely store your information and will not knowingly sell your personal data to third parties. 19) You acknowledge that no internet-based platform can ever be guaranteed completely secure. 20) We aim to make YourPING available 24 hours a day, 7 days a week, although availability may occasionally be interrupted by maintenance, updates, hardware failure, connectivity problems or failures involving third-party providers. 21) We are not liable for compensation, damages or losses arising from temporary or prolonged service interruptions. 22) YourPING is provided on a subscription basis, and recurring payments will be collected automatically using the payment method you provide through our payment processor. 23) Failure to maintain an active subscription may result in suspension of your account, interruption of notifications or loss of access to the platform. 24) We reserve the right to change subscription pricing in the future and will provide reasonable notice of any pricing changes. 25) All payments made to YourPING are final, and we do not offer refunds for partial billing periods, unused time, dissatisfaction with the service, missed notifications or cancellation after payment has been taken. 26) You may cancel your subscription at any time. 27) Cancellation will stop future billing, but will not normally generate a refund for the current billing period. 28) We reserve the right to suspend or terminate accounts that abuse the platform, violate these Terms & Conditions, or use the service unlawfully. 29) You acknowledge that all intellectual property rights relating to YourPING, including its software, branding, systems, functionality and underlying code, remain the property of the company. 30) You agree not to copy, reproduce, reverse engineer, decompile, exploit or attempt to replicate any part of the platform without written permission from the company. 31) You agree not to use YourPING unlawfully, maliciously, fraudulently or in any way that interferes with the operation or security of the platform. 32) Any illegal activity may be reported to the relevant authorities. 33) YourPING integrates with third-party systems, including SMS, email, push notification and hosting providers, which are outside our direct control. 34) We are not liable for the withdrawal, interruption or failure of any connected third-party service, though we will use reasonable endeavours to replace them. 35) We continually improve and develop new features for YourPING and reserve the right to modify, add, remove or withdraw functionality at any time. 36) We may invite users to test experimental or beta functionality from time to time. 37) You agree to indemnify and hold harmless the company, its directors, employees, contractors and agents against any claims, liabilities, damages, losses or expenses arising from your use of YourPING or your breach of these Terms & Conditions. 38) These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England & Wales. 39) Any disputes arising from the use of YourPING shall fall under the exclusive jurisdiction of the courts of England & Wales. 40) If you have questions
